Bureau’s of Expertise experts provide services for participants of public procurement:

1. 1. Confirmation of changes in market prices of the goods.
   2. Expertise on changes in essential contract terms on delivery time-limit.

Contract drafting process based on trade results is regulated by Article 36-37 Law of Ukraine ‘On Public Procurement’. Part 4 of Article 36 contains norm, according to which essential terms of the contract can’t be changed after its signing before obligations fulfilment by the parties except cases described in this law, such as:

• • cost changes of an item for less than 10% due to price fluctuation on such item at the market in condition that specified change won’t increase the sum defined in the contract
  • extension of the contract and fulfilment of obligations on goods transferring, execution of work and providing service in the case of documented objective circumstances which cause such extension, and disasters, delays in funding of client’s spending in condition that these changes won’t increase the sum defined in the contract

Parties have the right to make changes to the essential terms of the contract in the mentioned cases only if these changes have documentary evidence.

Namely experts of Bureau of Expertise of Chernihiv RCCI can conduct a research and by its conclusions validate price changes or presence of documented objective circumstances which caused the necessity of the contract extension and obligations fulfilment according to the contract.
